This section of Booking Terms and Conditions contain impertinent information which is why it is essential to read this over carefully and understand the fine print before you decide to travel or book your trip. The Booking Terms and Conditions constitute a legally binding contract between Apex Himalaya Treks and our esteemed clients, which ensures satisfaction and safety as well as providing top quality services.
1.Reservations & Payment Methods
To process a booking, you must send us a completed Trip booking form that is available after clicking on ‘Book Now’ button at every trip page. If you are not booking fix departure dates and trying to sign up for customized trip then you can make the booking by filling the secured form available. We require you to send us a photograph, passport copy and insurance details via email to info@apexhimalaya.com after making the deposit payment through our secured booking system. After receiving the photocopy of your passport, photograph and insurance details with your 10% non-refundable deposit we will send you a final e-mail confirmation.All deposits required are per person per trip, on further deposit options. A bank service charge may apply and should be paid at the time of deposit.
For credit card payments, we only accept Visa or MasterCard and 4% credit card transaction fee will be required.
Remaining balance (90%) should be paid either upon arrival in Kathmandu. However, Apex Himalaya reserves the right to cancel your trip if the full amount not be paid on time and no refund of advance deposit will be returned. We accept last minute booking, however, full payment is then required.
2.Alterations, Cancellations & Booking Changes
If you want to make modifications to your customised itinerary (Not applicable for fixed departures) even after you confirmed your booking, it is possible. We provide free alterations one time. However, after this, we charge a US $30 dollar surcharge for every new modification but this must be made 15 days prior to your trip so that we can adjust our schedule to your new trip itinerary.
Cancellation of the trip is not possible and you will lose your 10% deposit amount. We won’t charge the amount if the trip is postponed (only once) with valid reason. Postponing notice is required a minimum of 30 days prior to trip departure. If you fail to give proper notice within 30 days prior to your trip departure or do not show up at your scheduled arrival time without prior notice, you will forfeit 100% of the total cost of your trip.
Note: Changes may be possible, but are not guaranteed.
3.Passports & Visas
All clients must have a valid passport with at least 6 months validity from return date. Nepalese visas can be obtained from the Nepalese Consulate in your country or arrival in Kathmandu Airport. Nepalese visas costs are the sole responsibility of clients.
4.Travel Insurance
It is compulsory for all clients to have travel insurance before undertaking any tour, which should provide protection for the full duration of your tour to cover personal injury, death, medical expenses, repatriation expenses, helicopter rescue, air ambulance and basic coverage for baggage etc. This is strongly suggested for all our esteemed client.
5.Health & Fitness
Before you set out to travel, it is advised that clients check with the local hospital regarding your health and fitness since tours and treks require a certain level of physical fitness in Nepal. Please notify Apex Himalaya of any pre-existing medical condition and/or disability that may affect your ability to travel.
6.Complaints
Should you have a complain of any sort concerning the trip or tour you must make it known to a tour leader or guide or the directing manager at the earliest opportunity who will take the appropriate action. We take your concerns seriously especially if they are discriminatory, fraudulent behavior, or sexual harassment claims. Take also the opportunity to fill out our feedback form in order to improve the quality of our service & company. We appreciate any kind of feedback.
7.Privacy
At Apex Himalaya Trek & Expedition Pvt. Ltd., each of our clients’ emails & personal details are strictly confidential and solely used for the purpose of processing enquiries, obtaining necessary permits, and operating trips. No personal information that you supply to us will be disclosed for any other purposes.
8.Clients’ Responsible
A tour / trek guide who represents Apex Himalaya Trekking & Expedition Pvt. Ltd. deserves all authority during your tours. If you commit any unlawful act, you are compelled to leave the tour. No refund will be made in such case.
9.Disclaimer
Apex Himalaya Trek & Expedition Pvt. Ltd. is working as an agent for carriers, hotels, restaurants, transport operators, airlines, tour, trek, mountaineering operators and other such services. Apex Himalaya follows the laid out terms and conditions of these above service provides with whom Apex Himalaya has made arrangement for its clients.
10.Risks & Liability
We are not held liable or responsible for any changes in the itinerary due to unavoidable circumstances such as government restrictions, political strikes or unrest, landslides, road blockage, floods, snow avalanche, cancellation of domestic flights or missed flights, delay, inability to provide seats, any loss, thefts of valuables or damages, load shedding, sickness or accident. Any extra cost incurring there of shall be borne by the client with due duration.
Assumption of Risk
The traveler/trekker understands and acknowledges that adventure travel is inherently risky, and that there is a significant risk of serious injury or death, even when all reasonable safety precautions are taken. The traveler/trekker agrees to assume all risks associated with the trip, including, but not limited to, the following:
- The hazards of traveling in mountainous terrain, including altitude sickness, avalanches, and falls.
- Accidents or illnesses in remote places without medical facilities.
- The forces of nature, such as storms, earthquakes, and wildlife encounters.
The traveler/trekker agrees that the company, its outfitters, employees, agents, and other members of the tour group will not be liable for any death, personal injury, illness, delay, loss, or damage to property that may occur during the trip, howsoever caused.
Acceptance of Risk
The traveler/trekker understands and accepts the risks associated with adventure travel along with the booking confirmation, as described in the Assumption of Risk statement above. The traveler/trekker voluntarily chooses to participate in the trip, despite these risks.
In addition, we are in no way responsible for the accuracy of any information given by service providers. Please be aware that information details (i.e. accommodation costs, exchange rates) are updated or changed; it’s best to recheck before coming. However, we will provide you with the most accurate and up-to-date information as best as we can.
